Au c\u0153ur de ce r\u00e9gime se trouve le concept de <strong>Fournisseur de services li\u00e9s aux crypto-actifs (CASP)<\/strong>.<\/p>\n<p>Mais que couvre exactement une licence CASP ? La MiCA d\u00e9finit <strong>10 services sp\u00e9cifiques li\u00e9s aux crypto-actifs<\/strong> qui sont soumis \u00e0 une r\u00e9glementation. Cet article pr\u00e9sente chaque service, explique ce que cela implique concr\u00e8tement et vous aide \u00e0 d\u00e9terminer si votre entreprise doit demander une autorisation.<\/p>\n<p><\/p>\n<p><strong>Qu'est-ce qu'un CASP ?<\/strong><\/p>\n<p>Un CASP est toute personne morale qui fournit <strong>services li\u00e9s aux crypto-actifs<\/strong> \u00e0 des tiers \u00e0 titre professionnel au sein de l'UE. Pour ce faire en toute l\u00e9galit\u00e9 au regard de la MiCA, l'entit\u00e9 doit :<\/p>\n<ul>\n<li>\u00catre \u00e9tabli dans un \u00c9tat membre de l'UE<\/li>\n<li>Demander une autorisation aupr\u00e8s de l'autorit\u00e9 nationale comp\u00e9tente<\/li>\n<li>Pr\u00e9ciser les services li\u00e9s aux crypto-actifs qu'elle a l'intention de fournir<br><br><\/li>\n<\/ul>\n<p>La MiCA pr\u00e9voit <strong>ne pas attribuer de cat\u00e9gories ni de niveaux<\/strong> aux CASP. Au lieu de cela, la licence est <strong>bas\u00e9 sur les activit\u00e9s<\/strong>: les entreprises ne sont agr\u00e9\u00e9es que pour les services pour lesquels elles ont d\u00e9pos\u00e9 une demande.<\/p>\n<p><\/p>\n<p><strong>Les 10 services li\u00e9s aux crypto-actifs r\u00e9glement\u00e9s au titre de la MiCA<\/strong><\/p>\n<p>Ces services sont r\u00e9pertori\u00e9s dans <strong>Article 3, paragraphe 1, point 15<\/strong> de la MiCA. Si votre entreprise fournit l'un de ces services au sein de l'UE \u2014 ou s'adresse \u00e0 des clients situ\u00e9s dans l'UE \u2014 <strong>vous devez demander une licence CASP<\/strong> couvrant ces activit\u00e9s sp\u00e9cifiques.<\/p>\n<p>Les entreprises peuvent choisir de solliciter un ou plusieurs services, en fonction de leur mod\u00e8le \u00e9conomique.
